These Terms of Use (“Terms”) govern your download, access to and use of the Prime Driving Test Routes mobile application (“App”).

By downloading, purchasing, accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Purpose of the App
The App provides driving-test practice routes, maps, navigation assistance and related educational information for learner drivers and other users.
The App is a practice and educational tool only. It does not provide official testing instructions, professional legal advice, emergency navigation or a guarantee of success in any driving test.
2. No Government or Testing-Authority Affiliation
The App and Sky Drivings School are not affiliated with, endorsed by or acting on behalf of:
Transport for NSW;
Service NSW;
the NSW Government;
any other Australian government department;
any driver-testing authority; or
Apple, Google or a mapping provider.
Any government, testing-centre or location names are used only to identify relevant geographical areas or describe the App’s intended functionality.
3. Route Accuracy and Changes
Driving-test routes may change at any time. Roads may also be affected by:
roadworks;
closures;
changed traffic conditions;
new signs or speed limits;
weather;
hazards;
testing-authority decisions; or
mapping and GPS inaccuracies.
We do not represent or guarantee that:
a route shown in the App is an official or current test route;
an examiner will use any particular route;
every road direction or map detail is complete or error-free;
the App will operate without interruption; or
use of the App will result in passing a driving test.
You must independently observe actual road conditions, signs, speed limits and lawful directions.
4. Driving Safety
Safety must always take priority over use of the App.
You must not hold, view, program or interact with a mobile device while driving unless this is lawful and can be done safely. Before driving, you should:
select and review the route;
place the device in a lawful and secure holder;
configure audio guidance where available; and
ensure that a qualified supervising driver is present when required by law.
While driving, you must:
comply with all road laws and licence conditions;
follow road signs, signals and police or authorised traffic directions;
drive according to actual traffic and weather conditions;
disregard any App instruction that is unsafe, unlawful or inconsistent with road signs; and
stop in a safe and lawful location before interacting with the App.
The App must not be used as a substitute for observation, judgement, qualified driving instruction or responsible supervision.
The App is not designed for emergency use. In an emergency, call 000 where appropriate.
5. Eligibility and Young Users
You must be legally capable of agreeing to these Terms.
If you are under 18, you must use the App with the permission and supervision of a parent or legal guardian. Learner drivers must also comply with all licence restrictions and supervision requirements that apply to them.
A parent or guardian who permits a minor to use the App is responsible for supervising that use.
6. Licence to Use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the App on devices that you own or control, subject to the applicable App Store or Google Play rules.
The App is licensed, not sold. No ownership of the App or its content is transferred to you.
7. Acceptable Use
You must not:
use the App for an unlawful, unsafe or fraudulent purpose;
use the App in a manner that distracts a driver or breaches road laws;
copy, reproduce, republish or commercially distribute App content without permission;
reverse engineer, decompile or attempt to obtain the App’s source code, except where applicable law expressly permits it;
bypass security, payment or access controls;
interfere with the App, servers or connected systems;
introduce malware or harmful code;
scrape or automatically extract routes, content or data;
falsely represent that you are associated with us;
use our routes or content to create a competing commercial product; or
infringe our rights or the rights of another person.
8. Location Services
Some features require access to your device’s location.
You may grant, restrict or withdraw location permission through your device settings. If permission is denied or withdrawn, live maps, navigation or route-progress features may not function properly.
GPS and mapping information can be delayed, unavailable or inaccurate. You remain responsible for observing actual road conditions and complying with the law.

9. Intellectual Property
The App and its original content—including route compilations, written descriptions, graphics, branding, design, software and databases—are owned by or licensed to Sky Drivings School and are protected by applicable intellectual-property laws.
Third-party maps, names, logos and other materials remain the property of their respective owners.
You may use App content only for your personal, non-commercial driving practice unless we give you prior written permission for another use.
10. Purchases and Subscriptions
The App may offer paid downloads, in-app purchases or subscriptions.
Purchases made through the Apple App Store are processed by Apple. Purchases made through Google Play are processed by Google. The relevant platform’s payment terms also apply.
Before confirming a subscription, the App or applicable store listing will display:
the subscription price;
the billing period;
the features included;
whether a free trial applies; and
whether the subscription renews automatically.
Where an auto-renewing subscription is offered:
payment will be charged through your Apple ID or Google Play account;
the subscription will renew automatically unless cancelled within the period specified by Apple or Google before renewal;
you can manage or cancel the subscription through your App Store or Google Play account settings; and
deleting the App does not automatically cancel a subscription.
Prices may vary by country, currency and applicable taxes.
11. Cancellations and Refunds
Apple or Google generally handles payment cancellations and refund requests for purchases made through its platform. You should submit a refund request through the store from which you made the purchase.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
If the Australian Consumer Law applies, you may be entitled to a repair, replacement, refund, re-supply or compensation where the App fails to meet an applicable consumer guarantee.
12. Third-Party Services
The App may use or link to third-party services, including Apple services, Google services and mapping providers.
We do not control independent third-party services. Their availability, accuracy and operation are governed by their own terms and policies.
To the extent permitted by law, we are not responsible for an interruption, error or change caused by a third-party service outside our reasonable control.
13. Privacy
Our collection, use and handling of personal information are governed by the Prime Driving Test Routes Privacy Policy, available through the App and at:

14. Updates and Availability
We may release updates to correct errors, improve security, update routes or add, change or remove functionality.
You may need to install the latest version to continue using some features. Older versions may stop working where they are no longer secure or compatible with current systems.
We may temporarily suspend the App for maintenance, security, legal or operational reasons. We do not guarantee that the App will always be available or compatible with every device.
15. Disclaimer
To the maximum extent permitted by law, the App is provided on an “as available” basis.
We do not guarantee that:
all route information is current, official, complete or accurate;
the App will be uninterrupted or free from errors;
GPS or mapping information will always be available or precise;
use of the App will prevent traffic offences, accidents or loss; or
you will pass a driving test.
You are responsible for deciding whether it is safe and lawful to follow any suggested route or instruction.
Nothing in this section excludes a right or guarantee that cannot lawfully be excluded.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful, including liability that cannot be excluded under the Australian Consumer Law.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable, including loss resulting from:
unsafe or unlawful use of a mobile device;
failure to observe road conditions or road rules;
reliance on an outdated or unofficial route;
GPS, network or mapping inaccuracies;
third-party service interruptions; or
use of the App contrary to these Terms.
Where our liability for a statutory guarantee may lawfully be limited, it will be limited to the remedies permitted by applicable law.
17. Suspension or Termination
We may restrict or terminate your access to the App where reasonably necessary because:
you materially or repeatedly breach these Terms;
your use creates a legal, safety or security risk;
you attempt to misuse, copy or interfere with the App; or
continued provision of the App is no longer reasonably practicable.
Termination does not affect rights or obligations that arose before termination.
You may stop using the App at any time. Uninstalling the App does not automatically cancel an active subscription.
18. Apple-Specific Terms
If you obtained the App through the Apple App Store:
these Terms are between you and Sky Drivings School, not Apple;
Apple is not responsible for the App or its content;
Apple has no obligation to provide maintenance or support for the App;
to the extent permitted by law, Apple is not responsible for claims relating to the App, including product-liability, regulatory, consumer-protection or intellectual-property claims;
you must comply with the App Store usage rules and other applicable Apple terms; and
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.
These provisions do not limit any rights that cannot lawfully be excluded.
19. Google Play-Specific Terms
If you obtained the App through Google Play:
these Terms are between you and Sky Drivings School, not Google;
Google is not responsible for the App or its content;
you must comply with the Google Play Terms of Service and applicable usage rules; and
you may install and use the App only on devices associated with your Google account and as permitted by Google Play.
20. Changes to These Terms
We may update these Terms to reflect changes to the App, our business, platform requirements or applicable law.
The updated Terms will be made available through the App or our website with a revised effective date. Where reasonably practicable, we will provide notice of material changes that adversely affect existing users.
Changes will not apply retrospectively unless required by law or agreed with you.
21. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You and we submit to the courts of New South Wales and courts entitled to hear appeals from those courts.
Nothing in this section limits any right a consumer may have to bring a claim in another jurisdiction under applicable consumer law.
22. General Provisions
If part of these Terms is invalid or unenforceable, it will be read down to the minimum extent necessary or severed without affecting the remaining provisions.
A failure to enforce a provision is not a waiver of that provision.
You may not transfer your rights under these Terms without our written consent. We may transfer our rights as part of a genuine sale or transfer of our business, provided that doing so does not materially reduce your rights.
